Who is responsible for processing your personal data?
COMERTIA is RESPONSIBLE (DATA CONTROLLER) for the processing of the USER’s personal data and informs them that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of 27 April (GDPR), and Organic Law 3/2018 of 5 December (LOPDGDD).
Why do we process your personal data?
To maintain a business relationship with the user. The operations planned for the processing are:
- Sending of commercial advertising by e-mail, fax, SMS, MMS, social networks or any other present or future electronic or physical means that allow commercial communications. These communications must be made through the DATA CONTROLLER and are related to their products and services, or to their collaborators or suppliers with whom they have reached a promotion agreement. In this case, third parties will never have access to personal data.
- For market studies and statistical analysis.
- To process requests, to answer queries or any type of request made by the USER through any of the contact forms are made available to them on the DATA CONTROLLER’S website.
- To send the on-line newsletter about news, offers and promotions in our activity.
Why can we process your personal data?
Because the treatment is legitimised by article 6 of the GDPR as follows:
- With the consent of the USER: sending of commercial communications and the newsletter.
- For the legitimate interest of the DATA CONTROLLER: to carry out market studies, statistical analyses, etc. and to process orders, requests, etc. at the request of the USER.
How long will we keep your personal data?
They will be kept for no longer than necessary to maintain the purpose of the processing or as long as there are legal requirements for their custody. When this is no longer necessary, they will be deleted with appropriate security measures to ensure the anonymisation of the data or their total destruction.
Who do we provide your personal data to?
No communication of personal data to third parties is provided except, if it is necessary for the development and execution of the purposes of processing, to our service providers related to communications, with whom the DATA CONTROLLER has signed the confidentiality and processing management contracts required by current privacy regulations.
What are your rights?
The USER’s rights are:
- Right to withdraw consent at any time.
- Right of access, rectification, portability and deletion of their data and limitation or opposition to their treatment.
- Right to file a complaint with the control authority (www.aepd.es) if they consider that the treatment fails to comply with current regulations.

MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER
USERS, by means of the corresponding boxes and by entering data in the fields marked with an asterisk (*) in the contact form or presented in downloaded forms, expressly, freely and unequivocally agree that their data are necessary for their request to be attended by the provider, and therefore that the inclusion of the data in the remaining fields is voluntary. The USER guarantees that the personal data provided to the DATA CONTROLLER is true and is responsible for communicating any changes.
The DATA CONTROLLER informs that all the data requested through the website are mandatory, as they are necessary for the provision of an optimal service to the USER. If not all data are provided, there is no guarantee that the information and services provided will be fully tailored to their needs.
SECURITY MEASURES
That, in accordance with the provisions of current regulations on the protection of personal data, the DATA CONTROLLER is complying with all the provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and clearly with the principles described in Article 5 of the GDPR, by which they are treated in a lawful, fair and transparent manner in relation to the data subject and are appropriate, relevant and limited to what is necessary in relation to the purposes for which they are treated.
The DATA CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to take the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS and has provided them with the appropriate information so that they can exercise them.
